Distribution Open Access (DOA) Knowledge Base

Comprehensive technical, commercial, and regulatory documentation for Industrial & Commercial solar power procurement under Maharashtra Electricity Regulatory Commission (MERC) and Ministry of Power guidelines.

Regulatory Framework & Overview

Distribution Open Access (DOA) is a statutory mechanism enacted under Section 42 of the Electricity Act, 2003, and codified in Maharashtra by the Maharashtra Electricity Regulatory Commission (MERC). It enables bulk electricity consumers—such as heavy manufacturing facilities, textile mills, steel foundries, chemical plants, and data centers—to purchase clean, cost-effective power directly from utility-scale offsite solar generating stations via the state grid (MSETCL / MSEDCL).

Statutory Foundation: Open Access in Maharashtra is principally governed by the MERC (Distribution Open Access) Regulations, 2016, along with its First Amendment (2019) and the landmark Second Amendment (2023), harmonizing state regulations with the national Green Energy Open Access (GEOA) Rules.

Through Open Access, eligible commercial and industrial (C&I) entities can transition 50% to 100% of their operational energy demand to renewable power, reducing landed electricity tariffs from ₹9.50 – ₹12.50/kWh (standard utility rates) down to ₹3.80 – ₹4.80/kWh.

Key Eligibility & Sanctioned Load Thresholds

Following the notification of the MERC (Distribution Open Access) (Second Amendment) Regulations, 2023, the eligibility threshold for green energy procurement has been significantly democratized:

CategorySanctioned Load / Contract DemandStatutory BasisApplication Scope
Green Energy Open Access (GEOA)≥ 100 kW (Single or Aggregated)MERC DOA 2nd Amendment 2023 / MoP RulesSolar, Wind, Hybrid & Battery Storage
Conventional Open Access≥ 1,000 kW (1 MW)MERC DOA Principal Regulations 2016Thermal, Gas & Conventional Power
Captive & Group Captive PowerNo Minimum Cap (Subject to technical feasibility)Electricity Rules 2005 (Rule 3)100% CSS & AS Waiver

Consumers with multiple electricity connections within the same distribution licensee’s supply territory can aggregate their sanctioned demand to meet the 100 kW requirement.

Open Access Procurement Models Comparison

Commercial power consumers can select from four principal operational structures depending on capital allocation appetite, regulatory preferences, and facility roof space:

Landed Tariff & Surcharge Components

The landed price per unit of solar open access power consists of generation base cost plus statutory transmission, wheeling, and balancing charges:

Statutory Approval & Commissioning Roadmap

Executing a commercial open access solar project requires adherence to standard operating procedures across MSETCL, MSEDCL, and the Electrical Inspectorate:

Step 01

Feasibility & Evacuation Study

Technical analysis of consumer load profile, 15-min TOD consumption data, nearest 33/66/132 kV MSEDCL/MSETCL substation capacity, and distance to solar park.

Standard Timeframe: 3 - 5 Days
Step 02

Grid Connectivity Approval

Submission of formal grid interconnection application with MSETCL/MSEDCL nodal agency and grant of Stage-I & Stage-II connectivity approval.

Standard Timeframe: 15 - 20 Days
Step 03

SPV Structuring & PPA/SHA Execution

Establishment of Special Purpose Vehicle (SPV) for Group Captive compliance, execution of 25-year Power Purchase Agreement (PPA) and Shareholder Agreement (SHA).

Standard Timeframe: 7 - 10 Days
Step 04

SEM / ABT Metering & Transmission Setup

Installation and testing of 0.2S Class Special Energy Meters at generator and drawal points with automated telemetry integration to SLDC Kalwa.

Standard Timeframe: 10 - 15 Days
Step 05

DISCOM Open Access NOC & CEIG Clearance

Obtaining statutory Chief Electrical Inspector to Government (CEIG) safety clearance and MSEDCL Chief Engineer Open Access NOC.

Standard Timeframe: 15 - 20 Days
Step 06

COD, SLDC Scheduling & Bill Credits

Commercial Operation Date (COD) declaration, daily scheduling via SLDC, and monthly solar unit credit adjustments on MSEDCL electricity bills.

Standard Timeframe: Continuous

Special Energy Metering (SEM / ABT) Standards

In accordance with CEA (Installation and Operation of Meters) Regulations and MSEDCL circulars, all Open Access drawal and injection points must feature certified Special Energy Meters (SEM):

Technical Specifications:
• Accuracy Class: 0.2S for Current Transformers (CT) and Potential Transformers (PT).
• Integration Interval: 15-minute block integration logging Active, Reactive, and Apparent energy.
• Telemetry: Automated AMR (Automated Meter Reading) transmitting continuous real-time load profiles to SLDC Kalwa.
